Overview and scope

This Privacy Policy explains how Built Lending ("Built Lending," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit our website, apply for or manage a loan, or communicate with us by text, phone, or email (together, the "Services").

By using our Services, you acknowledge the practices described in this policy. If you do not agree with them, please do not use our Services.

Information we collect in connection with a financial product or service may also be covered by federal law, including the Gramm-Leach-Bliley Act (GLBA). Where a law gives you different or additional rights than those described here, those rights apply. To opt out of our email communications, please send a request to privacy@built-lending.com.

Information we collect

We collect the personal information you give us and information generated when you use our Services. Depending on how you interact with us, this may include:

  • Identifiers and contact details: name, mailing and property address, email address, phone number, date of birth, and Social Security number or other government identification numbers.
  • Financial information: income, assets, liabilities, employment information, credit information, bank account and routing details, and payment information.
  • Loan and property information: the contents of your loan application, property details, entity and ownership information, and related underwriting data.
  • Documents you upload: tax returns, bank statements, identification, entity documents, and other files you submit through our website or portal.
  • Account information: your login credentials and account activity.
  • Communications: messages, call and text records, and the contents of forms or emails you send us.
  • Device and usage information: IP address, approximate location derived from your IP address, browser and device type, pages viewed, referring pages, dates and times of visits, and similar data collected through cookies and analytics tools.

We collect this information directly from you (for example, on applications and contact forms), from your use of our Services, and from third parties such as credit reporting agencies, title and escrow companies, appraisers, banks and other financial institutions, public records, and our service providers.

How we use your information

We use personal information to provide our lending services and run our business. Specifically, we use it to:

  • Evaluate, underwrite, close, and service loan requests, including pulling credit reports and verifying identity, income, assets, and employment.
  • Process payments, draw requests, payoffs, and extensions, and collect amounts owed.
  • Communicate with you about your application, loan, or account, including by email, phone, and text message.
  • Operate and secure your online account and detect and prevent fraud and other unauthorized activity.
  • Respond to your questions and requests.
  • Analyze how our website is used, improve its performance, and measure the effectiveness of our advertising and marketing.
  • Comply with legal, regulatory, recordkeeping, and reporting obligations, resolve disputes, and enforce our agreements.

How we share your information

We do not sell your personal information, and we do not share it with third parties for their own marketing or for cross-context behavioral advertising.

We disclose personal information only to service providers and other parties who help us operate our business and serve you, and only as needed for those purposes. These include:

  • Title and escrow companies, appraisers, insurers, underwriting and processing vendors, capital providers, and servicers.
  • Banks and payment processors that move funds on your behalf or ours.
  • Technology providers, including website hosting, customer relationship management (CRM), document storage, communications, and analytics providers.
  • Professional advisors such as attorneys, accountants, and auditors.

Our service providers are required to keep your information confidential and to use it only for the services they perform for us.

We may also disclose information when we believe it is required by law or legal process, to respond to government or regulatory requests, to protect our rights, property, or safety or those of others, or in connection with a merger, financing, or sale of all or part of our business.

Text messages and calls

By providing your phone number and opting in, you consent to receive calls and text (SMS) messages from Built Lending and its affiliates, which may include updates about your request, application, or loan, and may be sent using automated technology. Consent is not a condition of obtaining a loan or any other product or service.

  • Message frequency varies. Message and data rates may apply.
  • Reply STOP at any time to opt out of text messages. Reply HELP for help or contact us using the details in the Contact us section.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent information will not be shared with any third parties.

To opt out of marketing emails, use the unsubscribe link in any email or contact us. We may still send you transactional and servicing messages about your application or loan.

Cookies, analytics, and advertising

Our website uses cookies and similar technologies (such as pixels and log files) to keep the site working and secure, remember your preferences, understand how visitors use the site, and measure our advertising.

  • Google Analytics helps us understand site traffic and usage. You can opt out with the Google Analytics opt-out browser add-on.
  • Google Ads helps us measure how our ads perform. You can manage how Google personalizes ads in your Google Ad Settings.
  • Our CRM system records your interactions with us, such as form submissions and communications, so we can follow up with you.

Most browsers let you refuse or delete cookies. Blocking cookies may cause parts of the website to work less well. Some browsers also send a Global Privacy Control or "Do Not Track" signal; where required by law, we treat a Global Privacy Control signal as a request to opt out of the sale or sharing of personal information.

Security and retention

We use administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, and disclosure. These include limiting access to employees and vendors with a business need, password protection, and encryption of data in transit. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please protect your login credentials and never share your password. We will not ask for it by email, text, or phone.

We keep personal information for as long as needed to provide our services, meet our legal and recordkeeping obligations, resolve disputes, and enforce our agreements. Federal and state law may require us to keep loan records for years after a loan closes or an application is declined, and we may keep information longer where the law permits.

Your privacy rights

Depending on where you live, you may have rights over your personal information. These rights are described below for California residents under the California Consumer Privacy Act, as amended (CCPA), and many other states grant similar rights. Some information, including information covered by the GLBA, is exempt from these laws.

Your rights:

  • Know and access: ask what personal information we collect, use, and disclose, the sources and purposes, and request a copy of the specific information we hold about you.
  • Delete: ask us to delete personal information we collected from you, subject to legal exceptions, such as records we must keep by law.
  • Correct: ask us to correct inaccurate personal information.
  • Opt out of sale or sharing: we do not sell or share personal information, so there is nothing to opt out of.
  • Limit use of sensitive information: we use sensitive personal information, such as Social Security numbers, account logins, and financial account details, only to provide our services and for other purposes the law permits.
  • Non-discrimination: we will not treat you unfairly for exercising your rights.

California disclosures. In the past twelve (12) months, we collected the categories of personal information listed in Information we collect (identifiers, financial and commercial information, internet and device activity, approximate location, and sensitive personal information) from the sources described there, for the purposes described in How we use your information. We disclosed these categories to service providers for business purposes only. We have not sold or shared personal information, and we have no actual knowledge that we sell or share the personal information of anyone under sixteen (16).

How to make a request. Email privacy@built-lending.com or call (713) 275-7357. We will verify your identity by matching the information you give us with what we hold, and we may ask for more information. An authorized agent may submit a request on your behalf with your written permission, and we may ask you to confirm your identity with us directly. We aim to respond within forty-five (45) days and will tell you if we need more time. If we deny a request, you may appeal by replying to our response, and you may also contact your state attorney general.

Children, third-party links, and changes

Children. Our Services are not directed to anyone under 18, and we do not knowingly collect personal information from children under thirteen (13). If you believe a child has given us personal information, contact us and we will delete it.

Third-party links. Our website may link to or embed sites and tools run by others, such as forms and scheduling tools. Those sites have their own privacy policies, and we are not responsible for their practices.

Where we lend. We offer our loan products in all states except Arizona, Nevada, Oregon, Idaho, Utah, North Dakota, South Dakota, Minnesota, and Vermont.

Changes to this policy. We may update this policy from time to time. We will post the updated version on this page with a new "Last updated" date. Your continued use of the Services after a change means you accept the updated policy.
